KUALA LUMPUR – The War Crimes Tribunal has convicted former US President George W. Bush and seven of his associates as war criminals for torture and inhumane treatment of war crime victims at US military facilities.

However, being a tribunal of conscience, the five-member panel chaired by tribunal president judge Lamin Mohd Yunus had no power to enforce or impose custodial sentence on the convicted eight.

“We find the witnesses, who were victims placed in detention illegally by the convicted persons and their government, are entitled to payment of reparations,” said Lamin at a public hearing held in an open court at the Kuala Lumpur Foundation to Crimi­na­lise War yesterday.

He added that the tribunal’s award of reparations would be submitted to the War Crimes Commission and recommended the victims to find a judiciary entity that could enforce the verdict.

The tribunal would also submit the finding and records of the proceedings to the Chief Prosecutor of the International Criminal Court*, the United Nations’ Security Council.

On Thursday, head of the prosecution Prof Gurdial Singh Nijar said Bush had issued an executive order to commit war crimes in Iraq and Afghanistan.

Five former Iraqi detainees, who were tortured while being detained in various prisons, including Guantanamo Bay, were called to give their testimonies before the Tribunal during the trial which started on May 7.

The Court can generally exercise jurisdiction only in three cases, viz. if the accused is a national of a state party, if the alleged crime took place on the territory of a state party or if a situation is referred to the Court by the United Nations Security Council.[20] It is designed to complement existing national judicial systems: it can exercise its jurisdiction only when national courts are unwilling or unable to investigate or prosecute such crimes.[21][22] Primary responsibility to investigate and punish crimes is therefore left to individual states.[23]

Five former Iraqi detainees, who were tortured while being detained in various prisons including Guantánamo Bay, were called to give their testimonies before the Kuala Lumpur war crimes tribunal which began May 7, 2012. Professor Gurdial Nijar, who headed the prosecution said, “The tribunal was very careful to adhere scrupulously to the regulations drawn up by the Nuremberg courts and the International Criminal Courts.” The United States is subject to international law which makes this trial significant outside the jurisdiction of of Malaysia.

KUALA LUMPUR, 11 May 2012 – The five-panel tribunal unanimously delivered a guilty verdict against former United States President George W. Bush and his associates at the Kuala Lumpur War Crimes Tribunal hearing that had started on Monday.

On the charge of Crime of Torture and War Crimes, the tribunal finds the accused persons — former U.S. President George W. Bush and his associates namely Richard Cheney, former U.S. Vice President; Donald Rumsfeld, former Defence Secretary; Alberto Gonzales, then Counsel to President Bush; David Addington, then General Counsel to the Vice-President; William Haynes II, then General Counsel to Secretary of Defence; Jay Bybee, then Assistant Attorney General; and John Choon Yoo, former Deputy Assistant Attorney-General — guilty as charged and convicted as war criminals for Torture and Cruel, Inhumane and Degrading Treatment of the Complainant War Crime Victims.

Earlier in the week, the tribunal heard the testimonies of three witnesses namely Abbas Abid, Moazzam Begg and Jameelah Hameedi. They related the horrific tortures they had faced during their incarceration. The tribunal also heard two other Statutory Declarations of Iraqi citizen Ali Shalal and Rhuhel Ahmed, a British citizen.

Testimony showed that Abbas Abid, a 48-year-old chief engineer in the Science and Technology Ministry had his fingernails removed by pliers. Ali Shalal was attached with bare electrical wires and electrocuted and hung from the wall. Moazzam Begg was beaten and put in solitary confinement. Jameelah was almost nude and humiliated, used as a human shield whilst being transported by helicopter. All these witnesses have residual injuries till today.

These witnesses were taken prisoners and held in prisons in Afghanistan (Bagram), in Iraq (Abu Gharib, Baghdad International Airport) and two of them namely Moazzam Begg and Rhuhel Ahmed were transported to Guantanamo Bay.

In a submission that lasted a day, the prosecution showed in an in depth submission how the decision-makers at the highest level President Bush, Vice-President Cheney, Secretary of Defence Rumsfeld, aided and abetted by the lawyers and the other commanders and CIA officials — all acted in concert. Torture was systematically applied and became an accepted norm.

According to the prosecution, the testimony of all the witnesses shows a sustained perpetration of brutal, barbaric, cruel and dehumanizing course of conduct against them. These acts of crimes were applied cumulatively to inflict the worst possible pain and suffering.

After hearing the defence of the Amicus Curiae and the subsequent rebuttal the prosecution, the tribunal ruled unanimously that there was a prima facie case made out by the prosecution.

After hours of deliberation, the tribunal, in the verdict that was read out by the president of the tribunal Tan Sri Dato Lamin bin Haji Mohd Yunus Lamin, found that the prosecution had established beyond a reasonable doubt that the accused persons, former President George Bush and his co-conspirators engaged in a web of instructions, memos, directives, legal advice and action that established a common plan and purpose, joint enterprise and/or conspiracy to commit the crimes of Torture and War Crimes, including and not limited to a common plan and purpose to commit the following crimes in relation to the “War on Terror” and the wars launched by the U.S. and others in Afghanistan and Iraq:

(a) Torture;
(b) Creating, authorizing and implementing a regime of Cruel, Inhumane, and
Degrading Treatment;
(c) Violating Customary International Law;
(d) Violating the Convention Against Torture 1984;
(e) Violating the Geneva Convention III and IV 1949;
(f) Violating the Common Article 3 of the Geneva Convention of 1949.
(g) Violating the Universal Declaration of Human Rights and the United Nations Charter.

The Tribunal finds that the prosecution has established beyond a reasonable doubt that the Accused persons are individually and jointly liable for all crimes committed in pursuit of their common plan and purpose under principles established by Article 6 of the Charter of the International Military Tribunal (the Nuremberg Charter), which states, inter alia, “Leaders, organizers, instigators and accomplices participating in the formulation or execution of a common plan or conspiracy to commit war crimes are responsible for all acts performed by any person in execution of such plan.”

The Principles of the Nuremberg Charter and the Nuremberg Decision have been adopted as customary international law by the United Nations.  The government of the United States is subject to customary international law and to the Principles of the Nuremburg Charter and the Nuremburg Decision.

The Tribunal finds that the prosecution has proven beyond reasonable doubt that the accused lawyers, gave “advice” that “the Geneva Conventions did not apply (to suspected al Qaeda and Taliban detainees); that there was no torture occurring within the meaning of the Torture Convention, and that enhanced interrogations techniques, (constituting cruel, inhumane, and degrading treatment,) were permissible.”

The prosecution has also established beyond a reasonable doubt that the accused lawyers “knew full well their advice was being sought to be acted upon, and in fact was acted upon, and such advice paved the way for violations of international law, the Geneva Conventions and the Torture Convention.”

The accused lawyers’ advice was binding on the accused Bush, Rumsfeld and Cheney, each of whom relied on the accused lawyers’ advice.  Others, such as CIA Director George Tenet and Diane Beaver, officer in charge at Guantanamo, relied on the accused lawyers’ advice. The prosecution had established beyond a reasonable doubt that the accused lawyers are criminally liable for their acts, and for participating in a joint criminal enterprise.

The president read that the Tribunal orders that reparations commensurate with the irreparable harm and injury, pain and suffering undergone by the Complainant War Crime Victims be paid to the Complainant War Crime Victims. While it is constantly mindful of its stature as merely a tribunal of conscience with no real power of enforcement, the Tribunal finds that the witnesses in this case are entitled ex justitia to the payment of reparations by the eight convicted persons and their government.

It is the Tribunal’s hope that armed with the findings of this Tribunal, the witnesses will, in the near future, find a state or an international judicial entity able and willing to exercise jurisdiction and to enforce the verdict of this Tribunal against the 8 convicted persons and their government. The Tribunal’s award of reparations shall be submitted to the War Crimes Commission to facilitate the determination and collection of reparations by the Complainant War Crime Victims.

“As a tribunal of conscience, the Tribunal is fully aware that its verdict is merely declaratory in nature. The tribunal has no power of enforcement, no power to impose any custodial sentence on any one or more of the eight convicted persons. What we can do, under Article 31 of Chapter VI of Part 2 of the Charter is to recommend to the Kuala Lumpur War Crimes Commission to submit this finding of conviction by the Tribunal, together with a record of these proceedings, to the Chief Prosecutor of the International Criminal Court, as well as the United Nations and the Security Council.

“The Tribunal also recommends to the Kuala Lumpur War Crimes Commission that the names of all the eight convicted persons be entered and included in the Commission’s Register of War Criminals and be publicized accordingly.

“The Tribunal recommends to the War Crimes Commission to give the widest international publicity to this conviction and grant of reparations, as these are universal crimes for which there is a responsibility upon nations to institute prosecutions if any of these Accused persons may enter their jurisdictions.”

About Kuala Lumpur War Crimes Commission (KLWCC)
The KLFCW established the Kuala Lumpur War Crimes Commission (The Commission), to investigate cases of war crimes that have been neglected by established institutions such as the International Criminal Court. The Commission seeks to influence world opinion on the illegality of wars and occupation undertaken by major Western powers.

The Accused persons had committed the Crime of Torture and War Crimes, in that:
The Accused persons had wilfully participated in the formulation of executive orders and directives to exclude the applicability of all international conventions and laws, namely the Convention against Torture 1984, Geneva Convention III 1949, Universal Declaration of Human Rights and the United Nations Charter in relation to the war launched by the U.S. and others in Afghanistan (in 2001) and in Iraq (in March 2003); Additionally, and/or on the basis and in furtherance thereof, the Accused persons authorised, or connived in, the commission of acts of torture and cruel, degrading and inhuman treatment against victims in violation of international law, treaties and conventions including the Convention against Torture 1984 and the Geneva Conventions, including Geneva Convention III 1949.
The Kuala Lumpur War Crimes Commission (KLWCC) following the due process of the law is bringing this charge against the accused. In 2009, the Commission, having received complaints from torture victims from Guantanamo and Iraq, proceeded to conduct a painstaking and an in-depth investigation for close to two years. Two charges on war crimes were drawn and filed against the accused persons.
The Kuala Lumpur War Crimes Tribunal had heard the first charge in November 2011 against the two accused, former U.S. President George W. Bush and former British Prime Minister Anthony L. Blair who were after a 4-day trial found guilty of Crimes Against Peace. These two former heads of state violated the United Nations Charter and international law when they planned, prepared and invaded the sovereign state Iraq on 19 March 2003 without just cause.
At the first hearing in November 2011, the Tribunal had permitted the prosecution’s application to hear only the first charge. The second charge will now be heard at the second Tribunal hearing from 7 – 12 May 2012.
The Kuala Lumpur War Crimes Tribunal is constituted of eminent persons with legal qualifications. Point to note is that victims of torture will also be called to give evidence before the Tribunal. The cries of these victims have thus far gone unheeded by the international community. The fundamental human right to be heard has been denied to them. These witnesses will testify on the torture they had endured during their incarceration. The accused will have a right to cross-examine them as in any open court hearing.
The Tribunal will adjudicate and evaluate the evidence presented as in any court of law. The judges of the Tribunal must be satisfied that the charges are proven beyond reasonable doubt and deliver a reasoned judgement.
In the event the tribunal convicts any of the accused, the only sanction is that the name of the guilty person will be entered in the Commission’s Register of War Criminals and publicised worldwide. The tribunal is a tribunal of conscience and a peoples’ initiative.
The prosecution for the trial will be lead by Prof Gurdial Singh Nijar, prominent law professor and author of several law publications and Prof Francis Boyle, leading American professor, practitioner and advocate of international law, and assisted by a team of lawyers.
The trial will be a public hearing held in an open court on 7-12 May 2012 at the premises of the Kuala Lumpur Foundation to Criminalise War (KLFCW) at 88, Jalan Perdana, Kuala Lumpur. The hearing is open to members of the public.

19 November 2011 – Kuala Lumpur, Malaysia. Today, seven judges of the Kuala Lumpur War Crimes Tribunal sat to hear formal charges against former President of the United States George W. Bush and former United Kingdom Prime Minister Tony Blair for Crimes Against the Peace.

But before the actual proceedings could get underway, Defense Counsel Team Leader Jason Kay Kit Leon charged one of the Judges with bias. Prosecutors characterized the allegation of bias and request for recusal as a “surprise” attack for which the Court had not had the opportunity to prepare.

Judge Niloufer Bhagwat, who served as a Judge with the Tokyo International Tribunal for War Crimes in Afghanistan, wrote in her decision that she found George W. Bush guilty for waging war against Afghanistan and the Afghani people. In addition, Judge Bhagwat served as a prosecutor of George W. Bush at the People’s Tribunal on Iraq in 2005 in Istanbul. Defense Counsel alleged that because of Judge Bhagwat’s participation in these various efforts and due to the opinions she has issued, that she cannot be fair in these Kuala Lumpur proceedings. Judge Bhagwat did find that no Head of State, including George W. Bush, can exempt himself from international treaty organizations.

Judge Niloufer implored the panel in Istanbul to have the courage to speak the truth. Counsel for the defendants found Judge Alfred Webre made the point that George W. Bush was served appropriately but failed to appear at the various people’s tribunals seeking justice for the victims of his Presidential decisions to take the people of the United States to war.

However, he made the point in defense of his colleague, Judge Bhagwat, that President Bush did not fail to appear at a Vancouver dinner at which he collected a US$150,000 speaking fee. Judge Webre stated that perhaps the Tribunal should have offered the former U.S. President a sizeable speaking fee in order to gain his attendance at the Tribunal.

Francis Boyle, a part of the prosecuting team, spoke on the matter of bias and recusal based on precedents at the International Court of Justice and the United States Supreme Court, where judges are presumed to be able to render judgments despite what might appear at first glance to be conflicst of interests. Interestingly, both Democrats and Republicans in the U.S. have currently turned their sights onto two the Supreme Court Justices alleged to have bias on the President’s health care law which the Supreme Court has agreed to hear during this term. Justices Clarence Thomas and Elena Kagan have been challenged for by Republicans and Democrats, respectively, in the Court’s health care deliberations due to the financial ties of Mrs. Clarence Thomas to organizations against the law and Justice Kagan’s role in preparing the defense of the controversial health care law while she served as the Administration’s Solicitor General.

The Kuala Lumpur War Crimes Tribunal Chief Judge Abdul Kadir Sulaiman announced that he was “shocked” by the turn of events that required this matter to be aired in public. Judge Bhagwat announced that she would recuse herselF from Charge 1 deliberations; her decision was accepted by the Court, and she left the Chambers.

Defense Counsel then proceeded to argue that the Tribunal lacked jurisdiction to consider the actions of the President and Prime Minister. The Prosecution anticipated this line of argument and was prepared with its counter-argument and declared that they are prepared to show that war crimes have been committed and deriving its power directly from the people who refuse to be complicit in war crimes, the people will not be silenced and conscience cannot be silenced. Francis Boyle added that complaints had already been filed at the International Criminal Court (ICC) against both Bush and Blair, but that the ICC had refused prosecution. The Tribunal is expected to overrule Defense objection based on jurisdiction and proceed to the trial of President George Bush and Prime Minister Tony Blair.

The Kuala Lumpur War Crimes Tribunal is an initiative of Malaysia’s retired Prime Minister Mahathir Mohamad, who staunchly opposed the U.S.-led invasion of Iraq in 2003.

The tribunal will convene a four-day public hearing starting Saturday to determine whether Bush and Blair committed crimes against peace and violated international law in the Iraq invasion, said Malaysian lawyer Yaacob Hussain Marican.

“For these people who have been immune from prosecution, we want to put them on trial in this forum to prove that they committed war crimes,” Yaacob told The Associated Press.

Activists sent information about the charges to Bush and Blair recently but received no response, Yaacob said.

Francis Boyle, an American international law professor based in Illinois, will be among the prosecutors at the hearing, which follows two years of investigations by a Malaysian peace foundation founded by Mahathir that looked into complaints by people affected by the Iraqi war.

The effort is modelled after a 1967 Vietnam War crimes panel convened in Sweden and Denmark by philosophers Bertrand Russell and Jean-Paul Sartre, Yaacob said. The Vietnam tribunal said the U.S. committed acts of aggression against Vietnam and bombarded civilian targets, but it was mostly ignored in United States.

The Kuala Lumpur tribunal will have a seven-member panel of judges including two retired judges from Malaysia’s highest court, peace activist Alfred Lambremont Webre of the United States and Mumbai-based lawyer Niloufer Bhagwat of India.

If the tribunal finds Bush and Blair guilty, it will enter their names into a symbolic “Register of War Criminals.”

The tribunal is also scheduled to hold a separate hearing next year on charges of torture linked to the Iraq war against former U.S. officials including ex-Vice President Dick Cheney, former Secretary of State Donald Rumsfeld and ex-Attorney General Alberto Gonzales, Yaacob said.

OBAMA ON MARS Update: The trial of Bush and Blair concluded today. After the trial, three of the defense team co-counsel sought me out because they had read the Obama on Mars article and wanted to know more about Obama on Mars and the whole Project Pegasus/ teleportation/time travel update.

This post trial conference with counsel came after a 4-day hard fought trial in which defense counsel disqualified one of our judges for bias.

Conclusion: The Obama/Mars revelations are widely read around the globe, even by young lawyers in law firms in Malaysia.

Thus the cover-up (by CIA and others) is aggressively trying to keep this information from the public.

Former US president George Bush and his former counterpart Tony Blair were found guilty of war crimes by the The Kuala Lumpur War Crimes Tribunal which held a four day hearing in the Malaysia.

The five panel tribunal unanimously decided that Bush and Blair committed genocide and crimes against peace and humanity when they invaded Iraq in 2003 in blatant violation of international law.

The judges ruled that war against Iraq by both the former heads of states was a flagrant abuse of law, act of aggression which amounted to a mass murder of the Iraqi people.

In their verdict, the judges said that the United States, under the leadership of Bush, forged documents to claim that Iraq had weapons of mass destruction.

They further said the findings of the tribunal be made available to members of the Rome Statute and the names of Bush and Blair be entered into a war crimes register.

Both Bush and Blair repeatedly said the so-called war against terror was targeted at terrorists.

Lawyers and human rights activists present here say the verdict by the tribunal is a landmark decision. And the Kuala Lumpur War Crimes Foundation said it would lobby the International Criminal Court to charge former US president George Bush and Former British prime minister Tony Blair for war crimes.

War crime hearing against Bush, Blair begins

KUALA LUMPUR The four-day hearing by the Kuala Lumpur (KL) War Crimes Tribunal against former United States president George W. Bush and former British prime minister Tony Blair on a charge of war crimes began yesterday.

It is alleged that the duo had committed crimes against peace when they launched a war against Iraq on March 19, 2003 without the sanction of the United Nations (UN).

However, before actual proceedings began, defence counsel team leader Jason Kay Kit Leon raised two preliminary objections.

The first objection was a supposed lack of jurisdiction by the tribunal to try the former leaders.

The other was on grounds of apparent bias by one of the judges, due to previous involvement in other international tribunals for war crimes.

Judge Nilourfer Bhagwat was requested to recluse herself from the tribunal as she had previously served as a judge with the Tokyo International Tribunal for War Crimes in Afghanistan as well as a prosecutor in a different tribunal against Bush. The defence counsel said Bhagwat would not be able to be fair at the KL war crime proceedings.

After a 20-minute adjournment to discuss the defence counsel’s objection of apparent bias, Bhagwat decided to recluse herself and left the chambers.

Retired Federal Court judge Datuk Abdul Kadir Sulaiman, heading the tribunal, along with five other judges, proceeded to hear the defence counsel’s first objection.

Defence counsel argued that the tribunal lacked the jurisdiction to try the former leaders as it did not have the mandate of the UN Security Council.

Kay cited several international criminal tribunal cases which had the authorisation of the UN, including the international criminal tribunal for Rwanda.

“The mandate for the UN is necessary when we wish to indict war criminals,” he said, adding that the tribunal would be usurping the UN’s power of authority by carrying out its own trial. “Verdicts which have no legal effect are purposeless in upholding justice or maintaining international peace.”

Chief prosecutor Professor Gurdial S. Nijar and his team countered this argument by saying that the tribunal was a trial of conscience.

“War crimes have universal jurisdiction in that anyone can bring war criminals to account for their actions.”

He also said the KL tribunal was complementary to the UN in trying to establish a body of law in relation to war crimes.

The tribunal overruled the second defence objection and proceeded with the trial.

The hearing will end on Nov 22.

Present was chairman of the Kuala Lumpur Foundation to Criminalise War and former prime minister, Tun Dr Mahathir Mohamad.

A War Crimes Tribunal in the Malaysian capital has begun its hearing against George W. Bush and Tony Blair, charging the former officials for the invasion of Iraq and Afghanistan, Press TV reports.

The tribunal will determine whether the former US president and British prime minister committed war crimes and violated international law during the invasion of Afghanistan and Iraq.

The Kuala Lumpur War Crimes Tribunal is an initiative by Malaysia’s former Premier Mahathir Mohamad, who staunchly opposes US-led military adventures in various troubled regions.

The hearing comes after two years of in-depth investigation, including testimonials from Iraqi war victims by the Kuala Lumpur War Crimes Commission.

According to the Kuala Lumpur War Commission, both Bush and Blair had participated in the formulation of executive orders and directives to exclude the applicability of all international conventions and laws.

One complainant told the commission in 2009 that he was mistakenly detained and kept for six years in Guantanamo Bay under harsh conditions.

A notification of the trial was served to known addresses of the two, and to the US Embassy and the UK High Commission in Kuala Lumpur on September 19, 2011.

This comes at a time when the Perdana Global Peace Foundation has mounted a war crimes exhibition in the Malaysian capital.

The exhibition put on display gory images of decapitated bodies, to educate the public about the inhumane effects of war.

The exhibition also featured the infamous Abu Ghraib prison in Iraq along with life-sized mannequins to show the abuse and torture of prisoners by the US army.

Millions of people have lost their lives in the US-led invasions of Iraq and Afghanistan over the past years.
